HIGHCLERE CASTLE GIN X HUNT SLONEM AUCTION TO BENEFIT ST. PATRICK’S CATHEDRAL, NEW YORK CITY
Auction Terms & Conditions
1. Auction. Highclere Castle Spirits, LLC (“Highclere”) in collaboration with Lucky Charm LTD/Hunt Slonem Studio (“Slonem”), is proud to present the Highclere Castle Gin x Hunt Slonem Auction (the “Auction”). This exclusive event offers bidders the opportunity to acquire a one-of-a-kind bottle of Highclere Castle Gin, hand-painted by Hunt Slonem featuring his iconic Bunnies (the “Bunny Bottle”). (Highclere and Slonem collectively the “Auction Parties”).
2. Eligibility. Bidders wishing to participate in the Auction must be legal residents of the United States, at least 21 years of age and legally eligible to purchase alcohol in their jurisdiction.
3. Auction Format. The Auction will be conducted exclusively online, with electronic bids submitted through the designated auction platform at https://bid.highclerecastlegin.com (the “Platform”). No in-person or phone bids will be accepted.
4. Auction Duration. The Auction will open on March and close on April 18, 2025, at 12:00 PM EST. No bids will be accepted after the closing time.
5. Bidding Process. Bidders may submit electronic bids through the Platform at any time before the Auction closes. Bidders may receive notification if they are outbid but such notifications are not guaranteed. It is bidder’s responsibility to monitor bidding prior to the close of the Auction. All bids are final and legally binding. The Auction Parties shall have no liability in the event a bidder is not notified of being outbid. No retractions, cancellations, or modifications are allowed once a bid is placed. The highest bid received by 9:00 PM EST on April 18, 2025 will be the winning bid. In the event of a tie, the first bidderpart who submitted at that amount will be deemed the winner.
6. Bidding Integrity. Bids generated by script, macro or other automated means or practices, or by any means which subvert the bidding process will be void. Highclere reserves the right, in its sole discretion, to: (i) verify any element of any bid, related materials or bidder’s eligibility; (ii) to request additional information; and (iii) to disqualify any bidder whose participation may subject the Auction, the Auction Parties, or any of the Auction Parties’ advertisers, clients, or customers to controversy, negative publicity, scorn, or ridicule. By entering this Auction, you agree to provide any documentation or information deemed necessary by, and in a form acceptable to, the Auction Parties to satisfy the above requirement if asked by an Auction Party to do so. Highclere reserves the right to disqualify bids, suspend accounts, or take legal action against any bidder suspected of fraudulent activity or unfair bidding practices. The Auction Parties may cancel or extend the Auction at its sole discretion if deemed necessary.
7. Winning Bidder & Payment. The winning bidder will be notified via email within 24 hours of the Auction closing. Full payment must be completed within 48 hours of receiving the winning notification. Failure to submit payment within the allotted time may result in the item being offered to the next highest bidder. Payment shall be made directly to the St. Patrick’s Kilgen Organ Campaign through their online giving portal. The winning bidder must provide valid proof of payment to St. Patrick’s Cathedral before becoming eligible to receive the Bunny Bottle. No shipment or transfer of the Bunny Bottle will occur until payment verification is completed. The winning bidder may be eligible to claim a charitable deduction for a portion of the purchase price; however, the Auction Parties makes no representations or guarantees regarding the tax deductibility of the winning bid. The winning bidder is solely responsible for consulting with their tax professional to determine the extent, if any, of the tax deductibility of their contribution.
8. Shipping & Delivery. No Returns or Exchanges. The winning bidder is responsible for providing a valid shipping address where alcohol can be legally delivered. Highclere will coordinate shipping and provide tracking details once the item is dispatched. All sales are final. No refunds, returns, or exchanges will be permitted. Highclere is not responsible for any delays or issues related to shipping once the item has been dispatched.
9. Beneficiary of Proceeds. St. Patrick’s Cathedral New York City (“St. Patrick’s”) is not a sponsor, administrator, or otherwise affiliated with the Auction and has no involvement in its operation, promotion, or execution. The Auction is independently conducted by the Auction Parties. All proceeds from the Auction will be donated to St. Patrick’s Cathedral’s Kilgen Organ Campaign.
10. Legal Compliance. Bidders are responsible for ensuring they comply with all local, state, and federal regulations regarding the purchase and shipping of alcohol. Highclere reserves the right to verify the identity and age of any bidder before finalizing the transaction.
11. Privacy. Registration of the bidder with the Platform is required to participate in the Auction. When you register, Highclere will collect personally identifying information about you, including your name, complete mailing address, and email address. The information that you provide may be added to a centralized database and you will simultaneously be registered for the Highclere’s and/or the Auction Parties’ and their affiliate’s other websites as well. Your email address will not be sold or rented to unrelated third parties. 12. Future Offers. By participating in the Auction, bidders agree to receive emails, special offers and electronic newsletters from, or on behalf of, each of the Auction Parties for online direct marketing purposes, including but not limited to emails and future offers and promotions from the Auction Parties. Bidders’ contact and entry information will be shared among the Auction Parties. Prior to the close of the Auction, bidders may opt out of receipt of emails and other offers by contacting each Auction Party and asking to unsubscribe. After the close of the Auction, bidders may opt out of any of these mailing lists by following the unsubscribe process provided by each Auction Party or brand. Opting out will not affect the bidding process. By participating in the Auction, you hereby agree to the collection and usage of your personal information and acknowledge that you have read and accepted the corresponding privacy policy.
13. Arbitration. Except where prohibited by law, as a condition of participating in this Auction, bidders agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Auction, or the prize awarded, shall be resolved individually, without resort to any form of class action; and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at a AAA regional office in Connecticut; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will bidder be permitted to obtain awards for, and bidders hereby waives all rights to claim punitive, incidental or consequential damages including attorney’s fees or any other damages, other than for bidder’s actual out-of-pocket expenses (i.e., costs associated with participating in this Auction), and bidder further waives all rights to have damages multiplied or increased.
14. Releases. By participating in this Auction, bidders agree to release the Auction Parties and St. Patrick’s and any other organizations affiliated with the sponsorship, fulfillment, administration, support, advertisement or promotion of the Auction and each of their respective parents, agents, affiliates, subsidiaries, advertising and promotion agencies, and suppliers, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the “Released Parties”) from any and all actions, claims, injury, loss or damage arising in any manner, in whole or in part, directly or indirectly, from participation in this Auction.
15. Other. Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, undelivered, garbled or misdirected bids; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Auction, including, without limitation, errors or difficulties which may occur in connection with the administration of the Auction, the bidding process, the announcement of the winner, or in any Auction-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking or by any equipment or programming associated with or utilized in connection with the Auction. Released Parties are not responsible for injury or damage to bidders’ or to any other person’s computer related to or resulting from participating in this Auction or downloading materials from or use of the Platform. Highclere reserves the right, in its sole discretion to disqualify any person tampering with the entry process, the operation of the Platform or otherwise in violation of these terms and conditions. Highclere further reserves the right, in its sole discretion, to cancel, terminate or modify the Auction if the Auction is compromised by virus, technical corruption, non-authorized human intervention, epidemic, pandemic, or any other causes which, in the sole discretion of the Highclere, corrupt or affect the administration, security, fairness, proper play or integrity of the Auction.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE PLATFORM OR UNDERMINE THE LEGITIMATE OPERATION OF THIS AUCTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, HIGHCLERE WILL DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
Except where prohibited by law, submitting ab id constitutes permission to use each bidder’s name, hometown (city and state), voice, biographical information, likeness, photograph and any statements regarding this Auction in all media now known or hereafter discovered, for any purpose, including without limitation, in connection with, and to promote, market or advertise, the Auction, in whole or in part, without review, approval, credit or attribution, notification or payment from or to bidder or any person or entity, worldwide, in perpetuity, or on a winner’s list, if applicable. Auction is subject to all applicable U. S. federal, state and local laws and regulations.
